This Acceptable Use Policy ("Policy") outlines prohibited activities and acceptable usage of the digital loyalty card platform and related website located at www.perkstar.co.uk (the "Services" and the "Site," respectively), provided by Perkstar Ltd ("Perkstar," "we," "us," or "our"). By accessing or using the Services or Site, you agree to comply with this Policy.
This Policy forms part of, and should be read alongside, our Terms of Use and Subscription Agreement. A violation of this Policy constitutes a breach of those agreements.
1. Purpose
This Policy ensures the integrity, security, and lawful use of the Services and Site. It protects Perkstar, our customers, and the end users who interact with loyalty cards created through our platform. Violating this Policy may result in a warning, suspension, or termination of your account and access.
2. Prohibited Activities
2.1 Illegal Activities
You may not use the Services or Site to engage in, promote, or support illegal activities, including but not limited to:
(a) Fraud, money laundering, or identity theft.
(b) Violations of applicable laws, regulations, or sanctions.
(c) Disseminating or hosting unlawful content.
2.2 Loyalty Programme Misuse
You may not use the Services to:
(a) Create, distribute, or manage fraudulent loyalty schemes, counterfeit cards, or programmes designed to mislead or deceive end users.
(b) Artificially generate, inflate, or manipulate stamps, points, rewards, or any other loyalty programme data.
(c) Abuse referral, reward, or promotional mechanics for personal gain or in a manner inconsistent with their intended purpose.
(d) Collect end-user data through loyalty cards for purposes unrelated to operating a legitimate loyalty programme.
(e) Create loyalty cards or programmes that impersonate another business or brand without authorisation.
(f) Operate programmes that violate the guidelines or policies of Apple Wallet or Google Wallet, or that could jeopardise Perkstar's wallet credentials or integrations.
2.3 Infringement of Intellectual Property
You may not use the Services or Site to infringe upon the intellectual property rights of others, including the unauthorised distribution or use of copyrighted material, trademarks, patents, or trade secrets.
2.4 Malicious Content
You may not transmit, distribute, or store content that contains harmful code, including but not limited to:
(a) Viruses, malware, worms, or Trojan horses.
(b) Tools for phishing, hacking, or denial-of-service attacks.
2.5 Spam and Unsolicited Communications
You may not use the Services or Site to:
(a) Send unsolicited bulk emails or messages ("spam") in violation of applicable laws, including the Privacy and Electronic Communications Regulations (PECR) and the UK GDPR.
(b) Distribute harassing, abusive, threatening, or deceptive messages.
(c) Falsify message headers, sender information, or engage in phishing.
(d) Send marketing communications to end users without obtaining their prior consent where required by law.
2.6 System Abuse
You may not:
(a) Attempt to probe, scan, or test the vulnerability of any system or network without authorisation.
(b) Use the Services or Site in a way that disrupts, degrades, or impairs performance for other users.
(c) Access accounts, data, or systems without proper authorisation.
(d) Use automated means (bots, scrapers, or similar) to access or collect data from the Services or Site, except through Perkstar's published APIs.
(e) Attempt to reverse engineer, decompile, or disassemble any part of the Services.
2.7 Privacy Violations
You may not violate the privacy of others by:
(a) Collecting, storing, or distributing personal data without appropriate consent or lawful basis.
(b) Disclosing confidential information or trade secrets without authorisation.
(c) Processing end-user data in a manner that violates applicable data protection laws, including the UK GDPR and the Data Protection Act 2018.
2.8 Fraudulent or Deceptive Conduct
You may not use the Services to mislead or defraud users, such as:
(a) Misrepresenting your business, products, or services.
(b) Impersonating another individual, business, or entity.
(c) Making false claims about the benefits, terms, or conditions of a loyalty programme.
3. Your Responsibilities
You are responsible for all activities conducted through your account, including activity by your Authorised Users and any end users interacting with your loyalty programmes. You must ensure that your use of the Services, and the loyalty programmes you operate through the platform, comply with this Policy and all applicable laws.
4. Monitoring and Enforcement
Perkstar reserves the right, but is not obligated, to monitor usage of the Services and Site to ensure compliance with this Policy and to investigate suspected violations.
Where a violation is identified, Perkstar may take action proportionate to the severity of the breach, including:
Warning: For minor or first-time violations, Perkstar may issue a written warning and request that the issue is remedied within a specified timeframe.
Suspension: For repeated or more serious violations, Perkstar may temporarily suspend access to the Services while the matter is investigated or resolved.
Termination: For severe or persistent violations, Perkstar may permanently terminate your account and access to the Services in accordance with the Subscription Agreement.
Content Removal: Perkstar may remove or disable any content, loyalty cards, or programmes that violate this Policy, with or without notice.
Reporting: Perkstar may report violations to law enforcement, regulatory authorities, or affected third parties where appropriate.
5. Reporting Violations
If you become aware of a violation of this Policy, please notify us promptly at legal@perkstar.co.uk. Include all relevant details to assist with our investigation. We take all reports seriously and will review them in a timely manner.
6. Policy Modifications
Perkstar may update this Policy from time to time. Material changes will be communicated with at least 30 days' notice where practicable. Changes will be effective upon posting to the Site. Continued use of the Services or Site after changes take effect constitutes acceptance of the updated Policy.
